Terms of Service

These Terms of Service ("Terms") govern your access to and use of the RentingOS platform ("Service") operated by Dynamic Tech Solutions and Software LLC ("RentingOS," "we," "us"). By using the Service, you agree to these Terms.

1. Account Registration

You must be at least 18 years old and authorized to enter contracts on behalf of your business. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials.

2. Subscription Plans and Billing

2.1 Plans

Starter: $79/month or $790/year (up to 25 active subscriptions)
Professional: $249/month or $2,490/year (up to 250 active subscriptions)
Enterprise: custom pricing (unlimited subscriptions)

2.2 Free Trial

New accounts receive a 14-day free trial. No credit card required to start. At the end of the trial, you must select a paid plan to continue.

2.3 Billing

Subscription fees are billed in advance on a recurring basis (monthly or yearly). Payment is processed via Stripe. Failed payments result in account suspension after 7 days; data is retained for 30 days post-cancellation.

2.4 Price Changes

We may change prices with 30 days' notice. Existing subscribers keep their current price for 12 months from the change date.

Tax disclaimer: Our pricing is exclusive of any applicable sales tax. Customers are responsible for their own use tax filings according to their jurisdiction. We don't charge sales tax at this time.

3. Refunds

We offer a 30-day money-back guarantee for new annual subscriptions. Monthly subscriptions are non-refundable but cancellable anytime (no prorated refund for partial months).

4. Acceptable Use

You agree NOT to:

Violate any laws, including tax, anti-spam, financial regulations
Process payments for prohibited businesses (illegal, gambling, adult content, MLM)
Send unsolicited communications (spam) to your customers
Reverse-engineer, decompile, or modify the Service
Use the Service to compete with RentingOS
Exceed plan limits (subscriptions, API calls, storage)
Share your account with users outside your organization

Violations may result in immediate account suspension and termination.

5. Your Content and Data

You retain all rights to your content (customer data, contracts, invoices). You grant RentingOS a limited license to process your data solely to provide the Service.

You are responsible for:

Accuracy of customer data you import
Compliance with applicable laws (GDPR, CCPA, etc.) for your customers' data
Obtaining necessary consents from your customers

6. Intellectual Property

The Service, including all software, designs, logos, and documentation, is owned by RentingOS. You receive a non-exclusive, non-transferable license to use the Service per these Terms.

7. Service Level Agreement (SLA)

Starter & Professional: 99.9% uptime target (no SLA credit)
Enterprise: 99.95% uptime SLA with credits per contract
Scheduled maintenance announced 48 hours in advance

8. Disclaimers and Limitation of Liability

The Service is provided "AS IS" without warranties of any kind. RentingOS is not liable for:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, or business opportunities
Damages exceeding the amount you paid in the prior 12 months
Issues caused by third-party services (Stripe, Plaid, QuickBooks, etc.)
Force majeure events (natural disasters, government actions, internet outages)

Some jurisdictions don't allow these limitations — they may not apply to you.

9. Indemnification

You agree to indemnify and hold RentingOS harmless from claims arising from:

Your use of the Service in violation of these Terms
Your content, data, or actions toward your customers
Your violation of any third-party rights

10. Termination

You may cancel anytime from your account settings. RentingOS may terminate your account for:

Material breach of these Terms (with 14 days' notice to cure if curable)
Non-payment after 30 days past due
Suspicious or fraudulent activity
Government order or legal requirement

Upon termination, you have 30 days to export your data. After that, data is permanently deleted (except financial records retained per applicable laws).

11. Changes to the Service

We may add, modify, or remove features. We will notify you of material changes via email 30 days in advance. Continued use after changes constitutes acceptance.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of laws principles.

Disputes will be resolved through:

Good faith negotiation (60 days)
Binding arbitration in Miami, FL under AAA Commercial Rules
Class action waiver: disputes resolved individually, not as class actions

EU consumers retain their rights under EU consumer protection laws.

13. Changes to These Terms

We may update these Terms. Material changes notified via email 30 days in advance. The "Last updated" date reflects the latest revision.
